Court throws out Anwar’s suit against Dr M

 The Court of Appeal has struck out opposition leader Anwar Ibrahim’s appeal on a RM100 million defamation suit against former premier Dr Mahathir Mohamad.

Justice Abdul Malik Ishak,who led the three-member panel, allowed counsel, VK Lingam’s application, who appeared for Mahathir, to strike out the appeal on a technicality after a 75-minute break.

The technicality filed through a notice of motion by Lingam and supported by Mahathir’s affidavit centred on Anwar’s counsel having not prepared the memorandum of appeal via the national language, Bahasa Malaysia.

“This is in blatant disregard to provisions under Article 152 of the Federal Constitution read together with Section 8 of the National Language Act and the Interpretation Act or the Rules of the Court of Appeal,” Lingam submitted.

The court also struck out Anwar’s application filed today to seek an extension in time to submit a proper Memorandum of Appeal in Bahasa Malaysia.

Senior counsel Karpal Singh for Anwar had the court in stitches when he began his submission in Bahasa Malaysia before seeking permission from the court to speak in English.

“Such was the fuss in my learned friend (VK Lingam) to make this application seeming to champion the national language when in turn he stood up submitting in English without seeking the court’s permission,” said Karpal.

Karpal said the counsel (Lingam) was sly enough to bring this matter to the court’s attention, when the matter should have been brought up during case management.

Karpal said as senior members of the bar, Lingam should have educated and informed the other party about the mistake and not go through the back door by filing this notice of motion.

Anwar had sued the former prime minister for defamation over statements the latter made at a Suhakam conference.

KUALA LUMPUR: The case against Datuk V.K. Lingam in connection with the alleged brokering of judges, which was featured in a video clip, has been closed with no further action.

Minister in the Prime Minister’s Department Datuk Seri Nazri Abd Aziz said in a written reply to Lim Guan Eng (DAP-Bagan) on Monday that the investigation showed no criminal offence had been committed in the appointment of judges.

“After ACA officers investigated those involved in the video clip, it was concluded that there is no abuse of power.

“The Attorney-General (A-G) has decided that no further action is needed,” he said.

Meanwhile our MP for Batu Tian Chua is found guilty of hurting a cop who admitted he assaulted Tian first.

 Sentenced to jail and given a fine over and above the amount which, if appeals fail, will automatically disqualify him as an MP.

 Sentenced and fined for acting in self defence.

speak malay or face punishment? good heavens!

Berita Harian front-paged a report about the proposed amendment to the National Language Act 1963 and the Education Act 1996 to empower Dewan Bahasa dan Pustaka (DBP) to penalise the private sector and agencies that fail to use Bahasa Malaysia in official dealings.

The Attorney-General Chambers is studying the matter. Under the proposed law, action would be taken against those not using Bahasa Malaysia during meetings, preparation of minutes and official functions.

A draft of the proposed amendments to the Acts has been discussed with the Education Ministry and would be tabled in Parliament.

Good heavens! Positively preposterous eh wot? Shorely they can’t be serious? Resorting to coercion? Forcing us all to speak Malay? Un-bloody-believable ol’ chap.

They do not seem to have the foggiest that not a single soul outside their country (save perhaps those mad dogs in Indonesia) gives a tuppence, farthing and a ha’penny about this language, doo they?

Wot next I shudder to envisage – outlawing English? Heavens to murgatroyd!

What they should be doing is penalise all those who positively mangle the Queeeen’s Englisshh – those who do not know their grammar from their grandmother – off with their heads I sayy!

I should shorely have a word with my Member of Parliament so as to put a halt to this indubitable idiocy once and for all, shouldn’t I, wot wot?

‘1Toilet’ plan to let teachers and students mingle freely

KUALA TERENGGANU: The state government will introduce a “1Toilet” policy in a move to liberalise education, where teachers – and even principals – will soon have to share toilets with their students.

State Education, Higher Learning, Human Resource, Science and Technology Committee chairman Ahmad Razif Abd Rahman said the policy was mooted in line with the 1Malaysia concept, and teachers and students could have a feeling of “oneness”.

“We want students to have a sense of belonging that we believe would inspire them to excel further in their education. “When students share the toilets with the teacher, they (students) will believe that they are on par with academicians and this automatically invokes a sense of being important to an organisation, which, in this case, is the school,” he said here yesterday.

… and we’re wondering why this country is going down the toilet.
… would Najib think this is like throwing shit at his 1Malaysia campaign?

After which, we hear from another youth who, because of her understanding of her religion, eschews discrimination based on ‘race’, but in turn causes us to question … 

… “is there’s a danger that Islam, rather than race, could become the new divider in her vision of a future Malaysia?”

A question which Anwar Ibrahim answers.

what system of governance would you like for malaysia?

This idea came about when I received an email through the KeADILan Power e-group comparing the barbarism of civil law caning with the ‘indah’-ness of Syariah caning, complete with pictures of bloodied buttocks vs. what seemed to appear as ’soft’ taps of a Syariah caning sentence being meted out.

All I could ask in reply was, “and that makes it alright?”

Another who replied to the email said, among other things:

When I see pictures like this I like to ask Muslims – especially our brothers in the Opposition. Is this adil that you have to whip a woman? Where will you stop? In Sudan they are going to sentence a lady for wearing pants. Next time in Malaysia, if some Pas people had their way, they will ask for this too. 
Bands that have good clean music have been stopped and concerts threatened. 
Please Muslim brothers, let’s be moderate especially the Pas and Keadilan brothers .
The BN is coming with guns blazing and have announced that they will capture the Selangor government . 
 If you dont change your way of thinking you are actually helping them. Please throw Hasan Ali from Pas out. What he is doing is helping BN all the way. Throw him  out now or you will be dragged in into issues that you will have no choice but to support because he seems ‘more Muslim’ than others .
 Throw you weight behind the coalition. We need the numbers to win the next election .
If we lose it will be all your fault . There is no place for extremism in Malaysia . 
 The moderate – well versed with the Koran – Muslims must stand up and speak out against issues like these.
 
To which I replied:
 
Whipping people may have been appropriate in the 7th century but not in this day and age.
 
Caning as a punishment is barbaric, backward and bloody ridiculous and so should be abolished across the board.
Ditto for caning in schools – even whipping animals should be made a crime.
 
I’m also in full agreement with your suggestion on Hasan Ali – he’s a right royal thorn in Pakatan’s backside with his setting up of a moral police squad in Shah Alam and his attempts at banning the sale of beer in ‘Muslim-majority areas’.
I met him years ago and from then on, told myself, “this guy is a very highly educated fundamentalist – the most dangerous of all … we must keep a close watch on him, lest he run riot.”
 
The ‘moderate’ Muslims in KeADILan and PAS are not going to raise a peep against Hasan’s shenanigans, because they know that if they do, the Pas hardliners will brand them ‘anti-Islam’, ‘heretics’ or ‘traitors to Islam’ – a tried and tested manipulation - the moderates are afraid to speak out because they actually believe these manipulations - they believe they have an inferior knowledge of theology and so should defer to the “wisdom” of the ulamak.
 
The hardliners have also manipulated non-Muslims by saying ‘all religions want a morally upright society, so trust us to do that for you’. 
 
When we question - by what/whose standards of morality? - they will simply retaliate with their usual ‘you are non-Muslim, butt out of our affairs’ jive.
 
The one issue that is stopping the ENTIRE nation of right-thinking citizens from voting for Pakatan in the next GE is this Islamisation issue.
 
Yet PAS has deluded itself into believing that each by-election they win is a further mandate to run riot with their brand of Islamisation.
 
I believe it’s time for the ‘moderates’ regardless of religion or lack thereof, to articulate clearly and succinctly what we want of our next govt.
 
Perhaps we – all of us ‘moderates’ in this egroup - could brainstorm some sort of questionnaire and then do some sort of survey – “what i want my next govt to be”.
 
I’ll start with Q1 … “What system of governance would you like for Malaysia?”

please dialogue with these ugly muslims

To all my moderate, progressive Muslim friends in Parti Keadilan,

Look closely at every face in those photos and ask yourselves:

Who are these Muslims?

Why are they behaving this way?

Where have they learned this brand of Islam?

… and most importantly …

What can I do to influence them to adopt the true and beautiful teachings of Islam?

Please, my Muslim brothers and sisters in KeADILan, find out each of their names, where they live or work and visit them one by one. Seek to arrange a meeting with each of them to dialogue, in an amicable manner, the true and peaceful teachings of Islam.

It is heartening to know that Chief Minister Khalid has arranged to meet these people on the 5th of Sept.

I sincerely hope all of you will take that opportunity, not only to “explain the decsion why the relocation of the temple”, but to also conduct the first in a series of intra-religious dialogues with these, your Muslim brothers, in order to bring them closer to the true and compassionate teachings of your religion.

Further to this, I hope that someday in the near future, a similar dialogue will be held with your partners in PAS, to try and urge them to adopt a less fundamentalist, more progressive stance in light of the democratic and secular nature of our beloved Malaysia.

These Muslims are ugly now, but you can help them transform into beautiful, peaceful, compassionate Muslims like your goodselves.

Be not afraid of their belief that only they know what ‘true’ Islam is.

Be not cowed by their air of piousness and seemingly superior knowlege of theology.

Be not intimidated by their accusations that you are “traitors to Islam”.

For you are our hope for a One Better Malaysia.

math, sci, bm, english, jack, shit

There’s been a lot of talk, maybe too much talk about “Teaching Math and Science in Bahasa or English” with many views either rooted in smugness (ie: ‘my English is superb, so…’) or fear (ie: ‘my English sucks, so …’) or indignation (ie: “It was MY … apanamaa … idea, so HOW DARE YOU … apanama … scrap it, ah??”).

Whatever your take on the matter is, and wherever it’s rooted, let the Dead Alien have the last and authoritative word [... now that's absolute smugness for you]:

Keep Maths n Sci in BM. Learning English is not the be-all and end-all toward becoming globally competitive, there’s another, more important element: the ability to THINK independently and solve problems.
 
Keep Maths n Sci in BM. The Germans, Japanese, Chinese, Russians etc learn it in their mother tongue and look what they’ve offered the world (for better or worse). Language does not make one a master at math or science; an inculcation of inquisitiveness, exploration, innovation and invention will, which is what most developed countries’ education syllabi is aimed at. 

 The ed system here was never based on getting children to THINK, so changing a medium of instruction is NOT going to do jack.
 
Teacher training colleges neither aim to select the best candidates nor groom them to become ‘teachers’ but mere info providers.
 
Thus teachers today are of mediocre calibre, tasked at making their students memorise info.
Mediocre teachers beget mediocre students. Blaming a language for producing mediocrity is shooting the wrong target.
 
So teach Math n Sci in Malay for what it’s worth, but on three conditions:
 
i) make English a compulsory pass subject at PMR and SPM level.
 
ii) make entry requirements for teacher training colleges and the syllabi there more challenging – and offer ATTRACTIVE SALARIES once they graduate.
 
iii) teach teachers to encourage students to use their minds instead of their memory.

Apa Nama can apanama a million times, but jack shit will come out of it unless the above is addressed.
