parliament, here we come!

The facts [from Malaysiakini]

1. Anwar to contest in Permatang Pauh by-election.

2. Election Commission has a maximum of 60 days to call for one.
(Take a bet they’ll take 59.9 days)

3. Police investigations into the sodomy complaint have been completed and the papers are now with the Attorney-General’s Chambers for further action.

[The very same Attorney General who Anwar recently reported to the ACA for allegedly fabricating evidence in his 1998 trial ... hmmm what do you think AG will do?]

4. “We will not rule out the possibility of Anwar being arrested. And it looks like they are planning to charge him by Monday,” Tian Chua, PKR’s information chief, told AFP.

5. According to my usually reliable source, once a candidate has announced his candidacy, NOTHING can stop him from contesting – not arrest, criminal charges or jail. Take for example Hindraf’s M. Manoharan who contested and won the Kota Shah Alam state seat while detained under the ISA.

According to Malaysiakini: Even if he was arrested and charged, Anwar can still run in the by-election as he would only be disqualified if he was found guilty and slapped with at least a two-year jail sentence and/or fined more than RM2,000.

[Which means they have to arrest, charge, try and convict him all within 59.9 days]

The govt’s response: “We are not worried … we will face it … he is not a threat. It is a democratic process, good luck to him,” Home Minister Syed Hamid Albar told reporters. (Damn this bloody democratic process!! Dammmit dammit dammit!!!)

The govt’s options:

1] Arrest and charge him on Monday and the whole world will scream ‘conspiracy’.

2] Try, convict and sentence him in 59.9 days and the whole world would be screaming ‘conspiracy’.

3] Let him contest, and bring the full BN machinery, postal votes and other underhand tactics to defeat him … in Permatang Pauh where everyone and their pet cat is an Anwar fan.

4] Start packing their bags to leave Putrajaya on 16 September.

The govt is truly up shit creek without a paddle.

Altantuya was cold bloodedly najibbed after she attempted to petra Najib for anwarising her and not making the promised payments.
Razak was badawised into covering up for Najib while Najib balaed from the scene. Razak was actually anwarised.
However Najib lingamed that he had nothing to do with it and has been kayjaying on the topic in an attempt to prove his innocence.
Nevertheless, some quarters have been threatening that they have soileked evidence that Najib was involved.

“the” medical report … (updated 8.30pm)

BREAKING NEWS (7.30pm): Malaysian Insider exclusive:

Anwar to be charged for sodomy as police wrap up probe

But, according to the report, before they do arrest him ['soon' they say] they are “crossing the t’s and dotting the i’s” – as if they are arresting him for poor handwriting.

So how “soon” is soon? Is it “sooner than we think” or “later than we expect” or “never never on a Sunday a Sunday a Sunday”?

There have been allegations that The Malaysian Insider is an Information Ministry-backed project masquerading as an independent news site. The “About Us” tab says:

The Malaysian Insider is the brainchild of seasoned journalist Png Hong Kwang and Sreedhar Subramaniam, the former chief operating officer of ntv7. Our aim is to create an Internet newspaper which offers an unvarnished take on events and personalities in Malaysia.

A Google of “Png Hong Kwang” revealed: ”The site [Malaysian insider] is the brainchild of Png Hong Kwang, former executive editor of editorial production at New Straits Times”

A May 15 Star report:

Decipher doctor’s handwriting HERE

According to Malaysia Today: “Dr Mohamed Osman Abdul Hamid from the Hospital Pusrawi … has now taken his entire family and has gone into hiding because the police are looking for him and they want him to change his medical report.”

The cops, OF COURSE, deny this and go on to discredit this latest development as “an attempt to sabotage their investigations” [investigations or orchestrations?], as diligently splashed across the NST.

AS USUAL, the cops are going after the whistleblowers Malaysiakini and Malaysia Today and declined to comment on the medical report and whether they will investigate its veracity.

Although it’s solid evidence of Anwar’s innocence, the legal repercussions of leaking a private and confidential medical report will be forthcoming.

Malaysiakini reports describe Hospital Pusrawi’s administration going ballistic: “the hospital had launched an internal investigation on how Saiful’s medical report was leaked, which is widely considered as a major infringement of patient privacy.”

Last month, the NST allegedly obtained a copy of the Hospital Kuala Lumpur [HKL]’s medical report (which is diametrically different from Pusrawi’s), which HKL denied having leaked – refresh your memory here.

Meanwhile, in the Star, Health Ministry Director-General Tan Sri Dr Mohd Ismail Merican said the ministry would stand by the findings of the medical examination conducted on Saiful Bukhairi Azlan at the KL Hospital on June 28.

He said the examination was done according to standard operating procedures with strict adherence to medical ethics, confidentiality and professionalism.

“The details of the findings have not and will not be disclosed to any unauthorised personnel or agency. No one should speculate or draw conclusions or make assumptions as to the result of the medical examination,” he said…

Anggonnaminit! Didn’t the police classify the case as sodomy based on HKL’s medical report?

NST  2 July: … police had classified the case as sodomy after receiving the medical report on the accuser, Mohd Saiful Bukhari Azlan.

So what the hell is there to “speculate or draw conclusions or make assumptions as to the result of the medical examination”???

… or is this a roundabout way of saying “the police didn’t classify their case based on our original medical report, but on the one they made us write/wrote themselves …”??

Trivia question of the day:

Q: Why are the cops taking so long to wrap up their investigation?

A: Because THERE’S NOTHING TO INVESTIGATE! They’re waiting for the scriptwriters to send in ‘the next episode’.

This “Anwar saga” is another drama minggu ini orchestrated by the BN to divert our attention from :
i) the real story behind Altantuya’s murder,
ii)
the insane petrol prices, resulting in
iii) the insane 7.7% inflation rate. (Expect the rate to balloon insanely come Raya along with the drama minggu ini.)
iv) the need to give yourself a swift kick, if you voted BN on March 8, and vow NEVER to vote for them again.

(Hell, they’ll be happier still if our attention is further diverted, say, by having Christians and Muslims fighting over the right to use “Allah”.)

This diversion and the hoped-for loss in public confidence toward Anwar, would ensure Anwar’s defeat in the upcoming Kulim by-election.

I must admit, this is not the most earth-shatteringly original analysis, but hey, that’s why we have RPK’s blog.

SHOULD PAS BE ALLOWED TO REMAIN IN PAKATAN?
Malaysiakini 27 Jul [excerpts]:

Pakatan Rakyat should seriously consider whether Islamic party PAS should be allowed membership in the opposition coalition, said DAP chairman Karpal Singh.

He added that PAS leaders had also met with their Umno rivals in the name of Malay unity.

“Such a racial move by PAS is incongruous with the policies of DAP and Pakatan Rakyat,” said Karpal.

He also took issue with the suggestion by PAS spiritual leader Nik Aziz Nik Mat that Umno and PAS be dissolved and a new Malay-based party be formed.

“Such a revelation is startling and has serious ramifications, implications and consequences,” said Karpal.

The lawyer-cum-politician who defended PKR de facto leader Anwar Ibrahim against sodomy charges 10 years ago was also upset by PAS deputy president Nasharuddin Mat Isa’s remarks on the fresh round of sodomy allegations.

According to Nasharuddin, the Malays were beginning to believe the sodomy allegations against Anwar, which was made by one of his former aides, Saiful Bukhary Azlan.

“Nasharuddin’s statement is not only contemptuous and ill-advised, but an open attack on Anwar who is presently embroiled in efforts to tarnish his credibility by allegations of sodomy.”*

How do you solve a problem like PAS?

Moral policing and the imposition of one’s moral standards on another MUST be opposed, resisted and REJECTED at all costs!

ya allah! ‘no’ to human rights articles??

The weekly Catholic newspaper The Herald and Catholic Asian News [CANews] – a newsmagazine which “raises critical awareness of spirituality, human rights and social justice” - have received written warnings from the Home Ministry [Kementerian Dalam Negeri - KDN] NOT to publish human rights and social justice articles, and instead stick to “articles pertaining to your religion only.”

The warning letter came after two written notices, and if not complied with, will be followed by a ’show cause’ letter as a precursor to a suspension/termination of publishing license.

CANews’ lawyers have responded in writing to KDN to explain the Catholic-Christian meaning of the term “religion”, which includes matters of rights, justice and truth.

The KDN warnings came a few days before Information Minister Shabery Cheek was quoted in Bernama [20 Jul '08] as saying, “The govt. never meddles in news selection.”

CANews has in the recent past published issues covering among others, the 2008 Elections, the Royal Commission’s proposal for judicial reforms and the recent petrol price hike.

More developments as they arise…

In the meantime Charles Hector wrote this post on his blog: “Pakatan Rakyat should intervene [in The Herald's court case] on [the issue of] non-exclusivity of [the term] ‘Allah’: What is the position of the Pakatan Rakyat on this matter?

In the article “Is PAS a Past Phobia Among Christians?” by David Anthony, which appeared in the April 2008 issue of Catholic Asian News [CANews]: “PAS president Datuk Seri Abdul Hadi Awang … said: ‘They (non-Muslims) can use the word Allah freely…’”

However, the question posed by Charles is based on the assumption that PAS, PKR and DAP are
separate and autonomous entities and so have differing stands on this and other issues.

While this may be true for, say, the more contentious Hudud/Islamic State issue; [to which, I may point out, Anwar went on record in the same publication's February 2005 issue as saying that he agrees with the Islamic state concept "in the classical context ... but in the present context I'm committed to the Constitutional framework."].

On the other hand, for most, if not all other issues, one must, when viewing Pakatan Rakyat, take the entity as a whole.  

Therefore if one ‘department’ makes a ’stand’, it should be construed that this must also be the consensus of Pakatan Rakyat [PR]. We have extended this ‘courtesy’ to BN for the last 50 years, so why not accord PR the same?


Charles’ question asks specifically, Anwar Ibrahim’s stand on the matter.


I would make an informed guess that Anwar would not be so anal [no pun intended] as to make a fuss about how non-Muslims choose to refer to God, the way BN and their sycophant wolves in Arabic clothing are.

Pakatan Rakyat should intervene in non-exclusivity of ‘Allah’ usage case

It would be good if Pakatan Rakyat, or the PKR, DAP and PAS should also intervene in the Catholic Herald case…


WHY? Because all Malaysians would really like to know what Pakatan Rakyat’s position is on the matter, and as such they should intervene in this case as well…


Speaking at this ceramah taking this position or that is not enough (for after all, we know politicians – and how many cater to the crowd, changing positions depending on their audience..)


What is that case all about?


The applicant Roman Catholic Archbishop of KL Murphy Pakiam, had on March 19, filed for a judicial review against the internal security minister and the government over an order that banned the Herald from using the word ‘Allah’ in its Bahasa Malaysia section.


The government believes the word is exclusive to Muslims and threatened to close down the newspaper if it defied the prohibition.


The archbishop, on behalf of the weekly, is seeking several declarations from the court.


Among them, the Herald wants the court to declare that the decision to prohibit it from using the word ‘Allah’ in its publication is null and void and that the Herald is entitled to use the word in the publication and that the word ‘Allah’ is not exclusive to the religion of Islam. – The Malaysian Insider,

Christian Churches in Malaysia to intervene…


Before the 2008 General Elections, during campaigning period, the
PAS candidate in my area was very clear that the word ‘Allah’ was not for exclusive Muslim usage only – hence the other religions can also use it.


Sadly, the PKR candidate was NOT THAT CLEAR – he said that he was not well-versed in theology BUT in his personal view, he saw no problem for Christians and others to use the word ‘Allah’.


Anwar Ibrahim — ye, the de facto leader of the Pakatan Rakyat - what is the position of the Pakatan Rakyat on this matter? Is it the same as the position of the Barisan Nasional??

Pakatan Rakyat – do not HIDE and avoid making a STAND now on this very important issue.


Pakatan Rakyat – Parti Keadilan Rakyat,
PAS and DAP should also intervene.


Same too with regard to those BN political parties who some say may hold a very different view from the BN government – if you do not, then clearly MIC, MCA, GERAKAN, …..all do take the BN government’s position.


Taking a stand and a position on a matter like this is not easy – but it must be done.

 


Or, is the position of the State Religious Councils of Perak,
Penang, Selangor and Kedah – the position of the Pakatan Rakyat?

This is a
REAL issue – so make a stand.

govt never meddles in news selection

KUALA LUMPUR, July 20 (Bernama) — Information Minister Datuk Ahmad Shabery Cheek said the government has never meddled in the selection of news items by the media including those by Radio Televisyen Malaysia (RTM).He said the media was free to decide on the priority and never directed for certain news to be carried or which should be dropped.
“We want the media to think what is news value. I have never directed on what news to be given priority or not and leave it to RTM and the other media to find decide on the priority,” he said after presenting prizes at the international Mandarin debating competition here tonight.
Ahmad Shabery was commenting on the statement by PAS spiritual leader Datuk Nik Abdul Aziz Nik that the media had given excessive coverage to the sodomy case of Parti Keadilan Rakyat (PKR) adviser Datuk Seri Anwar Ibrahim causing disgrace although he has yet to be proven guilty.
The Kelantan Menteri Besar was disappointed that Anwar’s arrest was given wide coverage while his release was only given brief mention.
Ahmad Shabery said Anwar’s case would have been given wider coverage in a country which practices total media freedom.
“It would have become a lot bigger in a country without media control as the media will opt for sensationalism craved by the masses, just to sell the newspapers.”
He said the media reports were not made on government orders but in the interest of the people who wanted to know the latest developments.

Ahmad Shabery urged the media particularly RTM not to sensationalise the matter and to be fair to those involved.

The civil servant class of power brokers [read: police] almost don’t care who is in power; they just want a strong boss who can secure the current regime, and ensure that ‘business’ can be run as usual.

There’s simply too much at stake – and we are talking entire lives and careers forever besmirched and some serious prison time here – for business not to run as usual, or for any type of new order based on integrity, transparency and justice to take over.

Also in the same boat are certain former prime politicians still alive and kicking in the country, actively egging on a return to the old order.

Unfortunately for these agitators, they are still oblivious to what was written on the wall last March 8th. The good news is that the the voices of those seeking a better Malaysia for all, have matured and wisened up to these manipulations as well as learnt the value of holding fast to Gandhian principles in their struggle.

The [reformasi] movement has also reached out and expanded beyond its original circles to all right-thinking Malaysians, who will no longer stand and watch all that is decent and honourable stolen from beneath their noses.

I think schemers and plotters will find a stronger, more united Malaysia willing to resist peacefully to the very end.

FULL PRESS STATEMENT ON ANWAR IBRAHIM’S BLOG

EXCERPTS:
At about 12.45 pm, the IO, DSP Jude Pereira called Mr Nair to confirm about our attendance and Mr. Nair confirmed that we would attend that 2pm appointment. We were about to have a quick lunch at my house before proceeding to the IPK. 5 minutes later, we were ambushed by a team of masked and heavily armed police personnel near my house.

The police, through the IO were adamant that I should be detained and put in the police lock-up overnight, despite them knowing about my physical condition. I had to spend the night sleeping on a cold cement floor, which aggravated my back injury which was due to the beating I received from the then IGP, Tan Sri Rahim Nor on 20th September, 1998.

I take to task the IGP for this abuse of police power against me through the events I’ve narrated above. It appears that the events of the last few days, the nature of my unwarranted arrest, my overnight incarceration which was actually absolutely unnecessary, were an act of personal vengeance against me in retaliation to the reports I lodged earlier against him, which are now being investigated by the ACA.

In the course of the trial of the false allegations of sodomy in 1998, DNA evidence was fabricated and used against me. The persons responsible for the fabrication then were the IGP, SAC Rodwan and the AG, are new key players in this investigation.

Until now, I have been denied access to the police report made by the accuser against me.

My accuser is still under police protection and as such, any fabrication is possible if they take my DNA. My decision to refuse a DNA test is taken through advice of my lawyers and DNA experts, both local and overseas.

Anwar Ibrahim said today he was the victim of a “vendetta”, after being held overnight on sodomy accusations levelled by a young male aide.

Update1130am Malaysiakini:
[Anwar's lawyer] Sankara [Nair] said Anwar was complaining of back pain after having to spend the night on the floor last night.

Anwar is currently resting at home while a horde of reporters, including the foreign media, are waiting outside.

          There is also an endless stream of visitors.

At about 10.45am, Wan Azizah and her eldest daughter Nurul Izzah left the house.
“My husband is in pain,” the PKR president told reporters before leaving.

Lawyer: Anwar to be released at 1.00pm (Yes, he was held in the lockup overnight…)

“I received a call from one of the investigation officers and they agreed to grant Anwar police bail,” said [Lawyer] Sankara [Nair] who arrived at the police headquarters at 9am.

Police can detain Anwar for 24 hours after which they must apply for a court order that would allow them to remand him for up to 14 days without charge.

Anwar was arrested at about 1pm yesterday and the police have up to 1pm today to either release him or take him to the magistrate to apply for a court order to detain him further.

It is however unclear whether Anwar will be charged today. But a police bail is normally given without the suspect being charged.

The person will then be released from police custody but will have to report back to the police station at a specified date where the police have the option to procure charges.

If Anwar is to be charged today, the police will have to bring him to court.

A candlelight vigil is expected to take place in front of IPK tonight.
At 8.50pm according to M’kini, Anwar had been taken to hospital for what it believed to be DNA profile testing. (This was later refuted by police.)
According to police, he is NOT being arrested under S.377 [sodomy] but under S.111 – failing to report for questioning.

Considering that just yesterday, the police came out and gave a very public press conference (which also was shown on TV) that Anwar will only be arrested if he did not turn up on his own by 2.00pm, the act of arresting him before 2.00pm is very bad.
The police have lied not just to Anwar but also to the Malaysian Public – and I am pissed off.
Yesterday’s NST:
“We are giving him time and space. If he does not turn up by 2pm, we will have to take the necessary action,” [CID chief] Bakri [Zinin] said yesterday without elaborating.

BREAKING NEWS 1.23PM – 16 JULY

ACCORDING TO OUR SOURCE IN PARTI KEADILAN RAKYAT – DATUK SERI ANWAR IBRAHIM HAS JUST BEEN ARRESTED. THE CHARGE, AT THIS POINT IN TIME, IS STILL UNKNOWN.

Confirmation from Malaysiakini:
Opposition leader Anwar Ibrahim has been arrested by the police just outside his home in Segambut, Kuala Lumpur, at 12.55pm today.

The de facto PKR leader was on his way back to his house after being questioned by the Anti-Corruption Agency (ACA) when he was met by a team of police officers.

He was to go the Kuala Lumpur police headquarters for questioning on the sodomy allegations.

According to Malaysiakini, TV9 [or Astro Ch119] instead of TV3 will be telecasting the “Petrol Debate” tonite 9pm to 1000pm (and not 1030pm – ‘they’ reduced the debate time).

On Astro, it’s on Awani Ch501 and Bernama TV Ch502.

 The questions as to WHY they changed the terrestrial channels and why it’s not on RTM1:

According to Malaysiakini, Organiser, Agenda Daily’s Rosli Ismail, “This is only because TV3 is duty-bound to continue with programmes that have been slotted for that time.”

 Shabery has the cheek to say: RTM1 would not telecast the debate because he does not want to make  use of the government television channel, when he is the minister in charge.

 [Hint:Two channels reach East Malaysia, one doesn't. Two channels have greater viewership statistics, one doesn't]
